The People’s Republic of China Addendum
(this “Addendum”)

1. Application

Humansa Health (HK) Limited (“Humansa”, “we”, “us” or “our”) in Hong Kong is part of a group of companies including Twilight Wood Limited, Trinity Link Limited trading as HD Endoscopy Centre, and their related companies/affiliates/subsidiaries in or outside Hong Kong from time to time (as listed here: http://wwwstg.humansahealth.com/pics) (together, “Humansa Health Service Providers”). Humansa and Humansa Health Service Providers, both being part of the New World group of companies including New World Development Company Limited and its affiliated or related companies from time to time in Hong Kong (as listed here: https://www.nwd.com.hk/pics) (“New World Group”, or “NWG”), are committed to protecting personal data of individuals in territories where we and/or the relevant Humansa Health Service Providers do business.

If you are:

i. an individual located in Mainland China who uses the Application or visits the Website of Humansa and/or the relevant Humansa Health Service Providers, or otherwise provides personal data to us and/or the relevant Humansa Health Service Providers by phone or any other means from Mainland China whether for making enquiries, reservations or otherwise; and/or

ii. an individual holding a Mainland China passport and/or resident identity card who visits our and/or the relevant Humansa Health Service Providers’ physical centres in Hong Kong or otherwise uses our and/or the relevant Humansa Health Service Providers’ products and/or services by phone or any other means in Hong Kong,

your personal data will be processed by Humansa and/or the relevant Humansa Health Service Providers in accordance with this Addendum in addition to the respective Privacy Policy Statement of Humansa and/or the relevant Humansa Health Service Providers all of which adopt the New World Group Privacy Policy Statement (collectively referred to as “Humansa’s Privacy Policy Statement”), the New World Group Privacy Policy Statement (“NWG’sPrivacy Policy Statement”) and Humansa’s Personal Information Collection Statement (“PICS”), as well as the applicable data protection laws and regulations in Mainland China.

Therefore, before using any products and/or services of Humansa and/or the relevant Humansa Health Service Providers or providing any personal data to us and/or the relevant Humansa Health Service Providers, please ensure that you have carefully read, understood and agree to the PICS, the Humansa’s Privacy Policy Statement, the NWG’s Privacy Policy Statement and this Addendum.

For the purpose of this Addendum, “Mainland China” refers to the People’s Republic of China excluding the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”), the Macau Special Administrative Region of the People’s Republic of China and Taiwan. Unless defined otherwise, all defined terms (capitalised terms) in this Addendum shall have the same meaning as the defined terms in the Humansa’s Privacy Policy Statement, the NWG’s Privacy Policy Statement and the PICS.

In the event of any conflict or inconsistency, they shall be resolved in the following order of precedence (from higher to lower) in respect of such conflict or inconsistency: – (a) this Addendum; (b) the PICS; (c) the Humansa’s Privacy Policy Statement; and (d) the NWG’s Privacy Policy Statement.

2. Personal data

In this Addendum, “personal data” refers to various information related to an identified or identifiable natural person recorded electronically or by other means and does not include anonymized information. Personal data involved in this Addendum includes those set out in the PICS and Clause 5 of the NWG’s Privacy Policy Statement.

In addition, “sensitive personal data” refers to “personal data” that, once leaked or illegally used, may easily lead to violation of the personal dignity of a natural person or harm of personal or property safety. The “sensitive personal data” involved in the PICS, the Humansa’s Privacy Policy Statement, the NWG’s Privacy Policy Statement and this Addendum includes identity card number (or passport number, where applicable), residential address, patient number, marital status, Log Files, Tracking Data, transaction information (including your characteristics and transaction behavior), and Medical Information (as defined in the PICS, i.e., your health data, health records, medical information, history, condition, drug history and/or other relevant information relating to your health, body and/or medical condition).

“Process” or “processing” of “personal data” includes the collection, storage, use, processing, transmission, provision, disclosure, deletion, etc. of “personal data”.

3. How we and/or the relevant Humansa Health Service Providers collect and process your personal data

Apart from the PICS and Clauses 5 and 6 of the NWG’s Privacy Policy Statement, the following also applies to how we and/or the relevant Humansa Health Service Providers collect and process your personal data:-

For the avoidance of doubt, when you are using the Application, visiting the Website or otherwise providing your personal data to us and/or the relevant Humansa Health Service Providers by phone or any other means from Mainland China, we and/or the relevant Humansa Health Service Providers will not collect and process your Medical Information. In any event, we and/or the relevant Humansa Health Service Providers will only collect and process your Medical Information subject to the Terms and Conditions of Humansa and/or the relevant Humansa Health Service Providers for the provision of the Humansa Goods and Services.

c. For us and/or the relevant Humansa Health Service Providers to carry out the Purposes (including the Purposes For Collecting Medical Information) and provide you with the relevant products/services, the personal data (including sensitive personal data) set out above, which may be collected from you, Humansa, the relevant Humansa Health Service Providers and/or third parties authorised by you, is necessary. If such information are not available or not accurate, we and/or the relevant Humansa Health Service Providers may not be able to perform the Purposes (including the Purposes For Collecting Medical Information) and/or provide the relevant products/services to you.

d. In general, we and/or the relevant Humansa Health Service Providers process your personal data with your consent, and where appropriate, with separate consent from you for processing your personal data under specific circumstances required by the applicable data protection laws and regulations in Mainland China. You acknowledge and agree that under the following situations, we and/or the relevant Humansa Health Service Providers are not required to obtain your consent to process your personal data (including Medical Information):-

(i) the processing is necessary for the conclusion or performance of a contract to which you are a party, or where it is necessary to conduct human resources management according to lawfully formulated labour rules and lawfully concluded collective contracts;

(ii) the processing is necessary for the performance of our and/or the relevant Humansa Health Service Providers’ duties or obligations under any applicable laws and regulations, including those directly related to:
a. National security and national defence;
b. Criminal investigation, prosecution and trial and execution of court orders, judgments or related matters; or
c. Public security, public health, or major public interest;

(iii) the processing is necessary for responding to public health emergencies, or for the protection of life, health and property safety of natural persons under emergency circumstances;

(iv) the personal data is processed within a reasonable scope to conduct news reporting, supervision by public opinion and other activities in the public interest;

(v) the personal data is made available to the public by you or the personal data about you from legitimate public sources is processed within a reasonable scope in accordance with the laws and regulations; or

(vi) other circumstances as provided by the laws and regulations.

4. Your rights as the personal data subject

  1. Please refer to the PICS and Clause 15 of the NWG’s Privacy Policy Statement in relation to your rights to access, correct your personal data and withdraw your consent. Further, in accordance with the applicable data protection laws and regulations in Mainland China, we and/or the relevant Humansa Health Service Providers will ensure that you may exercise the following rights over your personal data, including:-

    a. You may request to us and/or the relevant Humansa Health Service Providers (as the case may be) to delete your personal data if:-

    (1) our and/or the relevant Humansa Health Service Providers’ (as the case may be) processing of your personal data breaches laws or regulations;
    (2) we and/or the relevant Humansa Health Service Providers (as the case may be) collect or use your personal data without your consent;
    (3) our and/or the relevant Humansa Health Service Providers’ (as the case may be) processing of your personal data breaches our/their agreement with you;
    (4) you no longer use our and/or Humansa Health Service Providers’ products and/or services, or the purposes described in Clause 3 of this Addendum have been achieved or accomplished;
    (5) you withdraw your consent;
    (6) we and/or Humansa Health Service Providers no longer provide products and/or services to
    b. Change the scope of your consent;
    c. Obtain a copy of your personal data; or
    d. Request to transfer your personal data to another personal data processor provided that such request is compliant with the applicable laws and regulations.

  2. Such requests shall be made to our Personal Data Privacy Officer via the contact details set out in Clause 10 of this We will endeavour to reply to your reasonable requests in relation to the above within fifteen (15) PRC working days from the day we receive your request.
  3. However, please note we and/or the relevant Humansa Health Service Providers may refuse your requests under the following circumstances:-
    a. Circumstances relevant to the fulfilment of our and/or the relevant Humansa Health Service Providers’ obligations under laws and regulations, including our and/or the relevant Humansa Health Service Providers’ provision of your personal data (including your sensitive personal data) generated during the transaction between you and us and/or the relevant Humansa Health Service Providers to the regulatory authority(ies) and or other governmental departments under the laws and regulations of Mainland China;
    b. The data retention period required by any law or administrative regulation has not expired, or it is difficult to delete personal data technically (in such cases, we and/or the relevant Humansa Health Service Providers will take necessary security protection measures to ensure the security of your personal data or anonymize such personal data);
    c. Circumstances directly related to national security and defence security;
    d. Circumstances directly related to public security, public health, or significant public interest;
    e. Circumstances directly related to criminal investigation, prosecution and trial, and execution of court decision;
    f. Circumstances where we and/or the relevant Humansa Health Service Providers have sufficient evidence to prove that you have subjective malice, or you are abusing your rights;
    g. Circumstances where protection of your or other individual’s life, property and other important lawful rights is involved;
    h. Circumstances where responding to your request will cause serious harm to the lawful rights and interests of you or other individuals or organisations (including us and/or the relevant Humansa Health Service Providers); or
    i. Circumstances where trade secrets are involved.

5. Retention of personal data

Your personal data will be kept by us and/or the relevant Humansa Health Service Providers for no longer than necessary for the fulfillment of the Purposes. Please refer to Clause 8 of the NWG’s Privacy Policy Statement for further details.

6. How we and/or the relevant Humansa Health Service Providers entrust others to process, share, transfer and publicly disclose your personal data

a. To achieve the Purposes under Clause 3 of this Addendum, you understand and agree that we and/or the relevant Humansa Health Service Providers may entrust the processing of your personal data (including sensitive personal data but excluding Medical Information which is governed under Clause 6(b) of this Addendum) to agents, contractors, suppliers and service providers as set out in the PICS and Clauses 9 and 11 of the NWG’s Privacy Policy Statement as well as other entities specified under Index 3 of this Addendum.

b. We and/or the relevant Humansa Health Service Providers may also entrust the processing of your Medical Information to Third Party Service Providers as well as other entities specified under Index 3 of this Addendum (as the case may be) solely for their provision of data analytics, maintenance, administrative, data processing, data storage or other support services necessary to enable Humansa and/or the relevant Humansa Health Service Providers to carry out the relevant Purposes For Collecting Medical Information with your consent, but not for any other purposes or usages whatsoever.

c. The agents, contractors, suppliers and service providers and the other entities (as the case may be) entrusted by us and/or the relevant Humansa Health Service Providers have no authority to use your personal data for any other purposes. If there is any change to the purpose of processing of your personal data, we and/or the relevant Humansa Health Service Providers will ask for your consent again.

d. Your personal data (including your Medical Information, if/where applicable) may be shared with the relevant Humansa Health Service Providers for performing the Purposes (including the Purposes For Collecting Medical Information, if/where applicable), and also subject to your consent, for performing direct marketing and/or cross marketing for the Marketing Subjects, as the case may be.

e. Your personal data (except for Medical Information) may also be shared with the New World Group and joint venture companies together referred to as “NWG Affiliates” and our “Marketing Partners” located within or outside Hong Kong, which include property developers, banks, financial and investment institutions, insurance companies, private clubs, concierge and customer service providers, retail outlets and online businesses (products and services including fashion and beauty, health and personal cares, luxury, home and living, food, wine, and beverage, books and stationery), shopping malls, department stores, watches and jewellers (such as Chow Tai Fook Jewellery Group Limited), hotel chains, catering services providers, healthcare and senior care, services and/or products providers including health and wellness, art and culture, gallery and exhibition, green and nature, sports and recreation, travel and accommodation, leisure and entertainment, transportation and logistics, telecommunication, media and information technology, corporate innovation, accelerator and incubation programmes, competitions, conferences and events, pre-school, primary, secondary and/or tertiary education institutions etc. For the avoidance of doubt, none of your Medical Information will be used by Humansa and/or any Humansa Health Service Providers, and/or transferred to any NWG Affiliates and/or any Marketing Partners, for or in relation to direct marketing of those Marketing Subjects (including but not limited to direct marketing of NWG Goods and Services) where it is unnecessary, excessive or otherwise unjustified to use such Medical Information for direct marketing.

f. The details of recipients with whom your personal data may be shared with as elaborated under Clauses 6(d) and (e) above are set out in Index 1 of this Addendum.

7. How we and/or the relevant Humansa Health Service Providers store and transfer your personal data

In principle, we and/or the relevant Humansa Health Service Providers collect, produce and process the personal data (excluding Medical Information which will only be collected, produced and processed outside the Mainland China) in the Mainland China in accordance with the business purposes set out in Clause 3 of this Addendum and they will be stored in the Mainland China, Hong Kong and Singapore. You understand, authorise and consent that we and/or the relevant Humansa Health Service Providers may transfer your personal data (excluding Medical Information) outside Mainland China to our headquarters in Hong Kong, Humansa Health Service Providers, NWG Affiliates, Marketing Partners and other entities outside Mainland China (please refer to Index 2 of this Addendum for further details), and to the servers and/or data centres in Hong Kong and Singapore of our and/or the relevant Humansa Health Service Providers’ partners, co-operators, agents, contractors, suppliers and service providers whom we and/or the relevant Humansa Health Service Providers have entrusted to process your personal data (please refer to Index 3 of this Addendum for further details), due to business needs and solely for achieving the business purposes set out in Clause 3 of this Addendum and to the maximum extent permitted by law and in accordance with the mandatory requirements under the laws and regulations of the PRC. Hong Kong and Singapore have enacted personal information protection laws, and we and/or the relevant Humansa Health Service Providers will also ensure that your personal data is adequately protected in accordance with this Addendum. If you would like to learn more about the storage and cross-border transfer of your personal data, withdraw your consent and/or exercise your other rights in accordance with Clause 4 of this Addendum, please contact us via the means set out in Clause 10 of this Addendum and we will respond to your request to a reasonable extent.

We will not transfer your personal data to any company, organisation or individual outside of Humansa, Humansa Health Service Providers, NWG Affiliates, Marketing Partners and/or other entities specified under Index 1 of this Addendum, except under the following circumstances:

(1) Transfer with separate consent. After obtaining your separate consent, we and/or the relevant Humansa Health Service Providers will transfer your personal data to other parties in accordance with this Addendum;
(2) When we and/or the relevant Humansa Health Service Providers are involved in any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer or purchase of Humansa, any of the relevant Humansa Health Service Providers or our/their respective businesses (please refer to the PICS and Clause 18 of the NWG’s Privacy Policy Statement);
(3) We and/or the relevant Humansa Health Service Providers may otherwise transfer your personal data in accordance with applicable laws and regulations, requirements under legal proceedings, compulsory administrative or judicial requirements.

8. How we and/or the relevant Humansa Health Service Providers process minors’ personal data

Please refer to Annex A for the rules for processing minors’ personal data. If parents or legal guardian are aware that personal data of any minors aged below eighteen (18) under their care have been provided to us and/or the relevant Humansa Health Service Providers without consent, please notify us immediately to delete such personal data.

9. Miscellaneous

Further, the following Clauses in the NWG’s Privacy Policy Statement shall apply:-

a. Clause 4 shall apply in respect of the use of cookies and other tracking mechanisms;
b. Clause 12 shall apply in respect of the security of personal data;
c. Clause 13 shall apply in respect of circumstances where Humansa and/or the relevant Humansa Health Service Providers exclude liability for disclosure of your personal data, which will be subject to the applicable laws and regulations in Mainland China;
d. Clause 17 of the NWG’s Privacy Policy Statement and the section of “Miscellaneous” of the PICS shall apply in respect of the update of this Addendum.

11. Inconsistency or conflict

If there is any inconsistency or conflict between the English and Chinese versions of this Addendum, the English version shall prevail.

Annex A to the Addendum – Rules on processing minors’ personal data (hereinafter “Annex A”)

1. Application

This Annex A provides the rules of Humansa Health (HK) Limited’s and/or the relevant Humansa Health Service Providers’ activities in processing personal data of persons aged below eighteen (18) who are:-
i. located in Mainland China who use the Application or visit the Website of Humansa and/or the relevant Humansa Health Service Providers, or otherwise provide personal data to us and/or the relevant Humansa Health Service Providers by phone or any other means from Mainland China whether for making enquiries, reservations or otherwise; and/or
ii. holding a Mainland China passport and/or resident identity card who visit our and/or the relevant Humansa Health Service Providers’ physical centres in Hong Kong or otherwise use our and/or the relevant Humansa Health Service Providers’ products and/or services by phone or any other means in Hong Kong.
(The aforesaid persons aged below eighteen (18) hereinafter referred to as “Minor”, “Minors” or “Minor(s)”.)

If you are a Minor, please read the Humansa’s Privacy Policy Statement, NWG’s Privacy Policy Statement, the PICS, the Addendum and this Annex A together with your parents or legal guardians and obtain their consent before providing any personal data to us and/or the relevant Humansa Health Service Providers.

If you are the parents or legal guardians who would like to provide any personal data of Minor(s) under your care, please ensure that you have carefully read, understood and agreed to the Humansa’s Privacy Policy Statement, the NWG’s Privacy Policy Statement, the PICS, the Addendum and this Annex A before doing so.

In the event of any conflict or inconsistency concerning the processing of Minors’ personal data, they shall be resolved in the following order of precedence (from higher to lower): – (a) this Annex A; (b) the Addendum; (c) the PICS;(d) the Humansa’s Privacy Policy Statement; and (e) the NWG’s Privacy Policy Statement.

2. ​Personal data

Clause 2 of the Addendum applies, save and except that the “sensitive personal data” involved in this Annex A includes all Minors’ personal data.

3. How we and/or the relevant Humansa Health Service Providers collect and process Minors’ personal data

The following shall apply to how we and/or the relevant Humansa Health Service Providers collect and process Minors’ personal data:-

a. Minors’ personal data shall only be provided to us and/or the relevant Humansa Health Service Providers upon the consent of Minors’ parents or legal guardians. If the Minors’ parents or legal guardians subsequently withdraw the consent, they and the Minors shall immediately cease the provision of their personal data to us and/or the relevant Humansa Health Service Providers.

b. If Minors’ parents or legal guardians become aware that without their consent Minors under their care have provided personal data to us and/or the relevant Humansa Health Service Providers, please notify us to delete them by contacting our Personal Data Privacy Officer via the contact details set out in Clause 10 of the

c. Minor’s personal data (except for Medical Information) will be processed by us and/or the relevant Humansa Health Service Providers for the purposes as further specified below only (“Purposes for Minors”):-

If such information are not available or not accurate, we and/or the relevant Humansa Health Service Providers may not be able to perform the Purposes for Minors (including the Purposes For Collecting Medical Information For Minors).

c. In general, we and/or the relevant Humansa Health Service Providers process Minors’ personal data with their parents’ or legal guardians’ consent, and where appropriate, with separate consent from their parents or legal guardians for processing Minors’ personal data under specific circumstances required by the applicable data protection laws and regulations in Mainland China. Besides, disclosure of Minors’ personal data as above mentioned will be conducted in accordance with the applicable data protection laws and regulations in Mainland China.

4. ​Minors’ rights as the personal data subjects

Clause 4 of the Addendum applies to the extent that you as a Minor, or as the parents or legal guardians of the Minor(s), may exercise the Minor(s)’ rights as provided therein.

5. Retention of personal data

Clause 5 of the Addendum applies only to the extent for the Purposes for Minors (including the Purposes For Collecting Medical Information For Minors) and save and except that Minors’ personal data collected and processed for the purpose of Clause 3 of this Annex A will not be stored in our and/or the relevant Humansa Health Service Providers’ systems and shall be deleted once the said purpose has been achieved.

In addition, we and/or the relevant Humansa Health Service Providers strictly control the access to Minors’ personal data and only allow authorized personnel that are strictly necessary to process Minors’ personal data to access such data.

6. How we and/or the relevant Humansa Health Service Providers entrust others to process, share and transfer Minors’ personal data

a. To achieve the Purposes for Minors under Clause 3 of this Annex A, we and/or the relevant Humansa Health Service Providers may entrust the processing of Minors’ personal data (including sensitive personal data but excluding Medical Information which is governed by Clause 6(b) of Annex A) to agents, contractors, third party vendor, suppliers, public and governmental authorities, professional advisors and/or service providers as set out in the PICS and Clauses 9 and 11 of the NWG’s Privacy Policy Statement as well as other entities specified under Index 3 of the Addendum only to the extent necessary for the performance of the Purposes for Minors, including but not limited to ProCare Medical Imaging & Laboratory Centre, Prenatal Diagnostic Laboratory, Tsan Yuk Hospital, PathLab Medical Laboratories Ltd, Bio-Technology Limited, Pangenia Lifescience Limited, Dental Implant Surgical Ltd, Modern Dental Laboratory , Ornaments Dental Laboratory, Vanguard Computer Assisted Laboratory, Peak Dental Solutions which details are set out in Index 3 of the Addendum.

b. We and/or the relevant Humansa Health Service Providers may also entrust the processing of Minors’ Medical Information to Third Party Service Providers as well as other entities specified under Index 3 of the Addendum (as the case may be), including Gleneagles Hospital Hong Kong, SkinCentral Limited, solely for their provision of data analytics, maintenance, administrative, data processing, data storage or other support services necessary to enable Humansa and/or the relevant Humansa Health Service Providers to carry out the relevant Purposes For Collecting Medical Information For Minors with the consent of Minors’ parents or legal guardians, but not for any other purposes or usages whatsoever.

c. The agents, contractors, third party vendors, suppliers and/or service providers and other entities (as the case may be) entrusted by us and/or the relevant Humansa Health Service Providers have no authority to use Minors’ personal data for any other purposes. If there is any change to the purpose of processing of Minors’ personal data, we and/or the relevant Humansa Health Service Providers will ask for the consent of Minors’ parents or legal guardians again.

d. If you do not provide the required personal data, then we and/or the relevant Humansa Health Service Providers may not be able to perform the Purposes (including the Purposes For Collecting Medical Information) and/or provide certain goods or services to you (as the case may be).

If you are under 18 years of age, you should consult with your parent or legal guardian before sharing or providing your personal data to Humansa and/or the relevant Humansa Health Service Providers. To protect your interest as a minor, even if you agree for Humansa and/or the relevant Humansa Health Service Providers to use and disclose your personal data for the relevant purposes as specified in this Statement, we will require your parent or legal guardian to give consent on your behalf before we proceed to so use and disclose your personal data.

Kinds of personal data collected

The kinds of personal data Humansa and/or the relevant Humansa Health Service Providers may collect from you and/or third parties authorized by you include your name, gender, age (or age range), month and date of birth, identity card number (or passport number, where applicable), contact details, e-mail address, mailing/residential/correspondence address, contact number, patient number, membership number, marital status, family status, educational level, occupation, username and password, Log Files (see below), interests and favourite activities, tracking information about your use of the Application and/or the Website (as the case may be) and transaction information (including your characteristics and transaction behaviour) (“Tracking Data”), social media account information, etc. For Tracking Data collected through the use of cookies and other tracking mechanisms, please also refer to our related policies (including but not limited to the New World Group Privacy Policy Statement [and Cookies Policy])for further details as to how we collect, use and process Tracking Data.

Please note that your identity card number (or passport number, where applicable) will only be used for verifying your identity when providing you with service(s) requested from Humansa and/or any of the relevant Humansa Health Service Providers, dealing with your enquiry and registration of the relevant services.

Humansa and/or the relevant Humansa Health Service Providers may also collect from you and/or third parties authorized by you, your health data, health records, medical information, history, condition, drug history and/or other relevant information relating to your health, body and/or medical condition (“Medical Information”), and retain the same for performing the Purposes For Collecting Medical Information.

Purposes for using personal data collected

Your personal data (except for Medical Information) will be used and retained by Humansa and/or the relevant Humansa Health Service Providers (and/or the relevant NWG Affiliates and/or the relevant Marketing Partners as defined in the “Direct Marketing” section below, as applicable) for the following purposes (as may be applicable from time to time) (together, the “Purposes”):

The Medical Information to be collected from you and/or third parties authorized by you will be used and retained by Humansa and/or the relevant Humansa Health Service Providers only for the following purposes (as may be applicable from time to time) (together, the “Purposes For Collecting Medical Information”):

  • Providing you with the relevant services requested from Humansa and/or any of the relevant Humansa Health Service Providers;

Those with whom personal data is shared with

Your personal data (and some or all of your Medical Information, if/where applicable) may from time to time be provided by Humansa to the relevant Humansa Health Service Providers for performing the relevant Purposes (including, subject to your consent, performing the relevant Purposes For Collecting Medical Information, if/where applicable), and also subject to your consent, for performing direct marketing and/or cross marketing for the Marketing Subjects (see below section entitled “Direct marketing”), as the case may be.

Humansa and/or the relevant Humansa Health Service Providers may engage agents, contractors, suppliers and service providers (whether within or outside the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”)) in connection with the Purposes and/or the provision of the Humansa Goods and Services, e.g. IT/software solutions/technology services providers, marketing agents, social media, research companies, and service providers of development and maintenance, administrative, data processing, digital storage, or other similar services (together, “Third Party Service Providers”), and may transfer to or share your personal data (except for Medical Information) with them for the Purposes within or outside Hong Kong. Humansa and/or the relevant Humansa Health Service Providers may also share your personal data (except for Medical Information) (subject to your consent, if/where applicable) with the relevant NWG Affiliates, the relevant Marketing Partners (see below) and the social media platforms that we, the relevant Humansa Health Service Providers, the relevant NWG Affiliates and/or the relevant Marketing Partners (see below) use for such Purposes. We and/or the relevant Humansa Health Service Providers may also share your Medical Information with Third Party Service Providers solely for their provision of data analytics, maintenance, administrative, data processing, data storage or other support services necessary to enable Humansa and/or the relevant Humansa Health Service Providers to carry out the relevant Purposes For Collecting Medical Information with your consent, but not for any other purposes or usages whatsoever.

Where Humansa and/or the relevant Humansa Health Service Providers are required by the law of any country or place or requested by any court, regulatory body or governmental body of any country or place, we and/or the relevant Humansa Health Service Providers may also disclose your personal data as required.

In the event of any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer, or purchase of Humansa, any of the relevant Humansa Health Service Providers or our/their respective businesses, your personal data may be transferred to the new entity as part of the transaction, provided that the new entity abides by this Statement and continues to exercise the same level of care, in respect of your personal data, as we and/or the relevant Humansa Health Service Providers would. You will be notified of such event and you may decide to withdraw your consent to the use of your personal data.

Your personal data (including Medical Information) may be stored by us and/or the relevant Humansa Health Service Providers in physical locations and/or servers located within or outside Hong Kong. Your personal data (excluding Medical Information) may be stored by and shared with the relevant NWG Affiliates and/or the relevant Marketing Partners (see below) located within or outside Hong Kong. However, we and/or the relevant Humansa Health Service Providers will take all reasonable measures to ensure that your personal data (including Medical Information) is stored and processed securely, regardless of the country or place in which it is stored, and we and/or the relevant Humansa Health Service Providers will procure by contract or use our reasonable endeavours to ensure that the relevant NWG Affiliates and the relevant Marketing Partners (see below) do the same.

Direct marketing

Subject to your consent, Humansa and/or the relevant Humansa Health Service Providers may use your personal data (including Medical Information), and may conduct the relevant intra-group data transfers amongst the relevant Humansa Health Service Providers (including us), to send you direct marketing (including, but not limited to, special offers, news, information and marketing) about us, any of the relevant Humansa Health Service Providers, the relevant NWG Affiliates and/or the relevant Marketing Partners (see below) in relation to the Marketing Subjects (see below), whether by in-app messages and/or notifications and/or push notifications to your mobile device, post, email, telephone, text message, or other media whether now known or available in the future (together, “Communication Channels”).

Subject to your consent, Humansa and/or the relevant Humansa Health Service Providers may also transfer your personal data (excluding Medical Information) to the relevant NWG Affiliates and/or the relevant Marketing Partners (see below) so that they may send you direct marketing (including, but not limited to, special offers, news, information and marketing) about themselves, Humansa and/or the relevant Humansa Health Service Providers in relation to the Marketing Subjects (see below), whether by any of the Communication Channels.

The marketing partners of Humansa and/or the relevant Humansa Health Service Providers include property developers, banks, financial and investment institutions, insurance companies, private clubs, concierge and customer service providers, retail outlets and online businesses (products and services including fashion and beauty, health and personal cares, luxury, home and living, food, wine and beverage, books and stationery), shopping malls, department stores, watches and jewellers (such as Chow Tai Fook Jewellery Group Limited), hotel chains, catering services providers, healthcare and senior care, services and/or products providers including health and wellness, art and culture, gallery and exhibition, green and nature, sports and recreation, travel and accommodation, leisure and entertainment, transportation and logistics, telecommunication, media and information technology, corporate innovation, accelerator and incubation programmes, competitions, conferences and events, pre-school, primary, secondary and/or tertiary education institutions (“Marketing Partners”).

As Humansa and/or the relevant Humansa Health Service Providers may share your personal data (excluding Medical Information) with the relevant NWG Affiliates and/or the relevant Marketing Partners, we and/or the relevant Humansa Health Service Providers may also receive your personal data from them. Subject to your consent given to the relevant NWG Affiliates and/or Marketing Partners, we and/or the relevant Humansa Health Service Providers may also use such personal data to send you direct marketing about us and/or the relevant Humansa Health Service Providers, any of the relevant NWG Affiliates and/or Marketing Partners in relation to the Marketing Subjects (see below).

Subject to the restrictions as set out in the next paragraph regarding certain exclusions of Medical Information from use and/or transfer for direct marketing, the types of products, services, events and charitable initiatives that Humansa, the relevant Humansa Health Service Providers, the relevant NWG Affiliates and/or Marketing Partners (as the case may be) may market to you include the following (together, the “Marketing Subjects”):

  • goods and services offered by us and/or the relevant Humansa Health Service Providers in relation to the Humansa Goods and Services;
  • goods and services offered by our NWG Affiliates in relation to the NWG Goods and Services; pharmaceutical products, medical and pharmaceutical services, therapists;
  • consumer products and services by retail outlets and/or online businesses, including health and personal cares, baby products and sports;
  • gym and fitness services;
  • reward, loyalty, privileges programmes and promotions; medical services;
  • professional advice and/or consultation on personal enhancement;
  • charitable initiatives which support areas including sports, recreation, art and cultural programmes relief of poverty, advancement of education, advancement of religion and other purposes that are beneficial to the community.

For the avoidance of doubt, none of your Medical Information will be used by Humansa and/or any Humansa Health Service Providers, and/or transferred to any NWG Affiliates and/or any Marketing Partners, for or in relation to direct marketing of those Marketing Subjects (including but not limited to direct marketing of NWG Goods and Services) where it is unnecessary, excessive or otherwise unjustified to use such Medical Information for direct marketing.

Humansa and/or any of the relevant Humansa Health Service Providers cannot use or provide your personal data (including Medical Information, if/where applicable) for direct marketing purposes and/or provide your personal data (excluding Medical Information) to third parties (whether to our NWG Affiliates and/or the Marketing Partners) for their direct marketing purposes unless you consent. Even if you give your consent, you can opt out of direct marketing at any time (or you may request that we cease to provide your personal data to third parties, at which point we will cease to do so), free of charge, by writing to our Personal Data Privacy Officer at 30th Floor, New World Tower, 18 Queen’s Road Central, Hong Kong, or by email to privacy@humansa.com.hk or privacy@nwd.com.hk (marked Confidential).

Your rights

Apart from your right to opt out of direct marketing as mentioned above, you have the following additional rights to:

  • access your personal data held by Humansa and/or the relevant Humansa Health Service Providers;
  • require Humansa and/or the relevant Humansa Health Service Providers to correct any personal data which is inaccurate;
  • ascertain the policies and practices (from time to time) in relation to personal data and the types of personal data held by Humansa and/or the relevant Humansa Health Service Providers.

Where there are significant changes, we and/or the relevant Humansa Health Service Providers (as the case may be) will notify you and obtain your acceptance of the changes, consents, and/or opt in (as necessary or applicable). If you do not accept the changes and/or provide your consent, then we and/or the relevant Humansa Health Service Providers (as the case may be) may not be able to perform the Purposes and/or provide goods or services to you. You are advised to check the Application and/or the Website (as the case may be) for updates to this Statement on a regular basis.

Nothing in this Statement shall limit your rights under the PDPO.

your personal data will be processed by Humansa and/or the relevant Humansa Health Service Providers in accordance with the “People’s Republic of China Addendum” in addition to the respective Privacy Policy Statement of Humansa and/or the relevant Humansa Health Service Providers all of which adopt the New World Group Privacy Policy Statement, the New World Group Privacy Policy Statement and this Statement, as well as the applicable data protection laws and regulations in Mainland China, which for the current purposes, excludes Hong Kong, the Macau Special Administrative Region of the People’s Republic of China and Taiwan.
