Privacy Policy

This Privacy Policy is prepared in accordance with the Personal Data Protection (Privacy) Ordinance (Cap. 486) (the “Ordinance”). 

 

Humansa Health (HK) Limited (“Humansa”, “Company”, “we” or “us”) is committed to protecting the privacy and security of your personal information. This Privacy Policy is provided to you in connection with your dealings and provision of data or information to Humansa entities and brands including, without limitation, Humansa Company Limited, Humansa Imaging Limited etc. Unless advised otherwise, all references to Humansa, “Company”, “we” or “us” in this Privacy Policy includes, individually or collectively, Humansa entities and brands located in Hong Kong that process personal data as data users.  The rights and obligations of each Company under this Privacy Policy are several and not joint.  No Company shall be liable for any act or omission by another Company. 

 

For the purpose of this Privacy Policy, “Group Company” means Company and its holding companies, branches, subsidiaries, representative offices and affiliates, wherever situated, and any one of them. Affiliates include branches, subsidiaries, representative offices and affiliates of the Company’s holding companies, wherever situated (collectively, the “Group”).  

 

This Privacy Policy should be read together with the applicable Personal Information Collection Statement of the relevant service, website, and/or mobile application provided by the Company (“PICS”), provided that, in the event of any inconsistency between this Privacy Policy and the PICS, the PICS shall prevail. 

 

If you are under the age of 18, you should obtain consent from your parent or guardian before you provide your personal data. 

 

1.Personal Information We Collect 

For the different purposes in the course of conducting our business, you may be required to provide your personal data, which may include your name, gender, age (or age range),  month of birth, contact details, e-mail address, mailing/residential/correspondence address, contact number, membership number, marital status, family status, educational level, occupation, username and password, Log Files, Tracking Data, interests and favourite activities, transaction information (including your characteristics and transaction behaviour), social media account information, etc. Details of personal data to be collected will also be set out in the relevant PICS provided to you on or before collection of such personal data. 

 

When you use our website, we may collect and store information about your activities and website preference on our website for statistical and internal analysis purposes. For example, we may count the number of access / visitors to the different pages of our website and collect general usage patterns to measure the effectiveness and improve the usability of our website and the services provided through our website. Our server logs record IP (internet protocol) address, the date and time of the access / visit, the pages accessed, and documents downloaded, the previous site visits and the type of browser used. Such information collected is anonymous and does not contain name or address information or any information that will enable anyone to contact you. 

 

No attempt will be made to identify users of our website or their respective browsing activities from the information referred to in the previous paragraph except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect our server logs. This information is frequently reviewed for analysing our website’s usage statistics. 

 

By sending us an electronic mail message, you may be sending us personal information (for example, name, address, email address). We may store this information provided by you in order to respond to the request or to otherwise resolve the subject matter of your email. 

 

Some features of our website may require you to fill out registration forms when you request specific information and/or services. Other information that may be collected on our website (for example, through questionnaires, feedback forms or other means) enables us to determine a user / visitor’s interests, thereby in furtherance of our goal to provide better service.  

 

2.Use of Personal Data 

We will use your personal data for specific purposes identified in the PICS provided to you on or before your personal data is collected. This includes sharing your personal data with, and your personal data being used by, third parties as set out in the PICS for those purposes. 

 

3.Disclosure of Personal Data 

We will keep your personal data confidential but we may, in addition to our staff, transfer or disclose your personal data to third parties (such as your attending doctors/service providers, your insurer, our Affiliates, our agents and service providers or such other persons as permitted by any Law) for the purposes as set in the relevant PICS. We will also disclose your personal data as required by any Law. Except as stated above, we will not transfer or disclose your personal data to any third party without your prior consent. 

 

4.Use of Personal Data in Direct Marketing 

By virtue of the Ordinance and the PICS, we will not use your personal data for direct marketing purposes without your prior consent. With your consent which is not subsequently opt out, we may use your personal data for sending you promotional and direct marketing materials in relation to services provided by us / our Affiliates through various communication channels (such as SMS and electronic mail). 

 

5.Retention of Personal Data

We will not keep personal data for longer than is necessary for fulfilling the purposes (including any directly related purposes) for which they are, or are to be, used. Different retention periods apply to different types of personal data collected and are held by us in accordance with our retention policies. 

 

6.Change of Privacy Policy 

This Privacy Policy may from time to time be updated, revised and amended. Any update, revision or amendment will be effective immediately upon being posted on our website and/or mobile application. Where legally required, we shall notify you and/or obtain your consent for specific material updates, revision or amendment. If you do not accept the updates, revision or amendment, and/or provide your consent, then we may not be able to provide goods or services to you. You are advised to check our website and/or mobile application for updates to this Privacy Policy on a regular basis. 

 

7.Change of Control 

In the event of any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer, or purchase of us or our business or our affiliates or our affiliates’ businesses, we may need to transfer your personal data to the new entity in accordance with the PICS. You will be notified of such event and you may decide to withdraw your consent to the use of your personal data. 

 

8.Access and Correction of Information 

You have the rights to request in writing to us to: 

(a)check whether the Company holds personal data relating to you and to access such personal data; 

(b)require the Company to correct any personal data relating to you which is inaccurate; 

(c)ascertain our policies and practices in relation to personal data and to be informed of the kind of personal data held by the Company; 

(d)request the Company to cease using and/or processing your personal data;  

(e)change your preference in respect of our use of your personal data; and withdraw your consent to the use of your personal data for direct marketing purposes.

We are entitled to charge a reasonable fee for processing your personal data access requests. 

 

9.PRC Addendum 

If you are: 

(i)an individual located in Mainland China who visits or uses the relevant website(s) or mobile application(s) of Humansa and/or the relevant Affiliates, or other provides personal data to Humansa and/or the relevant Affiliates by phone or any other means from Mainland China whether for making enquiries, reservations or otherwise; and/or 

(ii)an individual holding a Mainland China passport and/or resident identity card who visits Humansa’s and/or the relevant Affiliates’ products and/or service by phone or any other means in Hong Kong, 

 

your personal data will be processed by Humansa and/or the relevant Affiliates in accordance with the “People’s Republic of China Addendum” in addition to this Privacy Policy and the PICS, as well as the applicable data protection laws and regulations in Mainland China which, for the current purposes, excludes Hong Kong, the Macau Special Administrative Region of the People’s Republic of China and Taiwan. For the purpose of this Statement, “Hong Kong” means the Hong Kong Special Administrative Region of the People’s Republic of China.  

 

10.Nothing in this Privacy Policy shall limit your rights under the Ordinance 

 

11.In case of discrepancies between the English and Chinese versions of this Privacy Policy, the English version shall prevail
